From January 1, 2025, the Vietnamese version of the Nice Classification 12-2025 Edition (NCL 12-2025), translated by the IP Viet Nam from the English version published by WIPO, will be applied to the classification of goods and services for trademark registrations. 
On August 23, 2023, the Vietnam Government promulgated Decree No. 65/2023/ND-CP detailing several articles and the implementation of the Intellectual Property Law 2022 (“amended IP Law 2022”) regarding industrial property rights, protection of industrial property rights, rights to plant varieties, and state management of intellectual property (“Decree No. 65”). According to the provisions in Appendix I - Part II of Decree No. 65, from January 1, 2025, in the section "List and Classification of Goods and Services of the Registration of Mark", the applicant must classify in accordance with the International Classification of Goods and Services under the Nice Agreement version 12-2025. Applicants who do not classify the designated goods and services correctly in accordance with the Vietnamese version of the NCL 12-2025 will have their goods and services reclassified by IP Viet Nam and have to pay additional fees according to the regulations.
Any matter arising during implementation of the NCL 12-2025 should be promptly informed to IP Viet Nam for resolution./.
